These terms govern your use of simplyit.biz and the services provided by Simply IT (FLOCALA LLC). By using our website or services you agree to these terms.
1. Services
Simply IT provides managed IT services, cybersecurity, cloud solutions, communication systems, and digital marketing services for businesses in North Central Florida and beyond. Specific services, pricing, and terms for your engagement are governed by the Master Services Agreement or Statement of Work executed between Simply IT and your organization.
2. Website Use
You may use simplyit.biz for lawful purposes only. You agree not to use the site in any way that violates applicable laws or regulations, transmit spam or unsolicited messages, attempt to gain unauthorized access to any part of the site or its systems, interfere with the proper functioning of the website, or copy, reproduce, or redistribute content without written permission.
3. Contact Forms and Inquiries
By submitting a contact form, assessment request, or chat inquiry you consent to being contacted by Simply IT via phone, email, or SMS in response to your inquiry. You represent that any phone number provided is a number at which you may be contacted and that you have the authority to consent to such contact.
4. SMS Terms
By providing your phone number and submitting a form on simplyit.biz you consent to receive SMS messages from Simply IT related to your inquiry and our services. Message and data rates may apply. 5. Intellectual Property
All content on simplyit.biz including text, graphics, logos, images, and software is the property of Simply IT or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.
6. Disclaimer of Warranties
Our website and its content are provided on an "as is" and "as available" basis without warranties of any kind either express or implied. Simply IT does not warrant that the website will be uninterrupted or error-free.
7. Limitation of Liability
To the maximum extent permitted by law Simply IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim arising from use of the website shall not exceed $100.
8. Indemnification
You agree to indemnify and hold harmless Simply IT, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the website or violation of these terms.
9. Governing Law
These terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Marion County, Florida. You consent to personal jurisdiction in Marion County, Florida.
10. Service Agreements
IT services engagements are governed by a separate Master Services Agreement signed by both parties. In the event of a conflict between these Terms of Service and a signed service agreement the signed service agreement controls.
11. Automated Access, Scraping, and Content Theft
All content on simplyit.biz — including pillar guides, comparison articles, case studies, free tools, copy, images, page templates, and proprietary frameworks — is the work product of Simply IT and is protected by U.S. copyright law and the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, Fla. Stat. §501.201 et seq.). The following activities are expressly prohibited absent prior written authorization from Simply IT: (a) automated scraping, crawling, harvesting, or systematic extraction of any portion of the site for commercial purposes or for reuse on any other website, product, or service; (b) republishing, reposting, or creating derivative works from any pillar guide, blog post, case study, or free-tool content, in whole or substantial part, on any third-party property; (c) training, fine-tuning, or grounding a large language model or other AI system on the contents of this website where the resulting model is offered commercially, except by AI services whose crawlers are explicitly allow-listed in our robots.txt and that respect documented opt-out signals; (d) circumventing or attempting to circumvent technical access controls including but not limited to rate limits, IP blocks, bot detection, honeypot URLs, and CAPTCHAs. Simply IT reserves all rights and remedies under the Digital Millennium Copyright Act (DMCA), the Computer Fraud and Abuse Act (CFAA), state trade-secret law, and FDUTPA, including but not limited to injunctive relief, attorney's fees, and statutory damages.
12. DMCA Notices
If you believe content on simplyit.biz infringes your copyright, or if you find Simply IT content republished without authorization elsewhere on the web and need to confirm ownership, contact our designated DMCA agent at info@simplyit.biz with the subject line "DMCA". Notices must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the material claimed to be infringing and its URL; (3) your contact information; (4) a statement that you have a good-faith belief that the use is not authorized by the copyright owner; (5) a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner; (6) your physical or electronic signature. Counter-notices follow the procedure set out in 17 U.S.C. §512(g).
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes are effective immediately upon posting. Continued use of the website after changes constitutes acceptance of the updated terms.
